1. Agreement
You should ensure that you read, understand and agree with all of the terms and conditions contained in this Agreement, which includes those terms and conditions expressly set out below and those incorporated by reference, which you can access by clicking on relevant links, before you become a user of the Site.
You should only use the Service (as defined below) if you have read and understood this Agreement and agree to abide by the terms and conditions of this Agreement, our game rules and our privacy policy. If you have any questions about this Agreement please contact us at support@nordicbet.com. You are bound by this Agreement in any event if you use the Service or the Software.
We may amend, modify or change any of the terms of this Agreement at any time by giving you notice ("Notice") by either email notification to the address you provided to us upon registration or by posting the amended Agreement on the Site. We may wish to modify the terms of this Agreement (including our privacy policy and game rules) to review, for example, any of our game rules, any minimum and maximum stakes offered or the rate of the commission (rake) which we charge.
If you do not agree to the updated terms and conditions you may terminate your use of the Service by notifying us that you wish to terminate Your Account (as defined below). Your continued use of the Service or the Software will be deemed to constitute your acceptance of the changes to this Agreement.

2. Membership Eligibility
Our services are not available to, and may not be used by, persons under the age of 18 or to temporarily or indefinitely suspended members. We reserve the right to request proof of age at any stage to verify that minors are not using the Service and we may exclude a person from play if proof of age is not provided or if the Company suspects that a person using the Service is underage.

3. Compliance with Laws
3.1 U.S. citizens or residents may not open an account and/or wager for real money.
3.2 Eligibility (outside of the United States of America) for non-U.S. citizens or residents; to open an Account and/or participate in any subscription service and/or tournament offered, you must (1) be a natural person, at least 18 years old or older if required in your locality, who is assigned to the e-mail address submitted on your account registration form; and (2) be physically located outside the U.S in a country in which participation in the tournaments offered is unrestricted by law. The rules governing sweepstakes, contests, and tournaments with entry fees and/or prizes are set up by each individual country and/or local government. It is your responsibility to participate in tournaments only if participation is not restricted or prohibited by your country of residence.
3.3 Additional persons not eligible not withstanding paragraphs 3.1 and 3.2; the following persons are ineligible to receive any prize or compensation from tournaments, sweepstakes, or other programs that we offer: employees, officers, directors and paid consultants (and their immediate family members) of Nordic Gaming Group, and their respective parent companies, subsidiaries, and affiliates; and any other person with access to non-public information regarding the operation of any tournament we offer. For purposes of this section, immediate family members include parents, siblings, spouses, children, or any other person permanently residing in the same household with such employee, officer, or director.

4. Description of Services
We provide users who register with us the opportunity to access and play online games and to wager with other users in relation to such games (the "Service").

5. Your Account
You may only have one account ("Your Account"), for which you will register using your own, correct name. You may not use the Service by means of another person's account. Should you attempt to open more than one account, under your own name or under any other name, or should you attempt to use the Service by means of any other person's account, we will be entitled to immediately close all Your Accounts and bar you from future use of the Service (regardless of the provider of the Service).
Upon termination of Your Account (either by you or by us) we will pay to you such monies as remain in Your Account, subject to the charge of an administrative fee. The fee may vary depending on the circumstances of termination. However, if termination was caused by your breach of this Agreement, the balance in Your Account will be forfeited.
You must choose a user name and password on completion of registration. You are responsible for all actions taken under that user name and password and shall only use or utilize the Site using your own user name and password. We recommend that you choose a sensible / memorable user name and password and that you keep them securely. You must make every effort to keep your password safe and should not disclose it to any other person. You shall not sell or transfer your user name to any other person. You shall also not permit, either directly or indirectly, any other person to utilize your user name or password. We are not responsible or liable for any losses or problems you suffer as a result of your disclosure of your user name to anyone else.
You must not choose a user name that is offensive to other players in the network. We reserve the right to close down any account with a user name that we reasonably consider is offensive. In such circumstances the balance in the account of the offending player will be forfeited.
If Your Account is inactive for at least 60 days and during that time has held no more than Euro 5 then we reserve the right to close Your Account and take the balance as the administration fee for closure.

6. Payment Transactions and Payment Fraud
In order to play any of the Games for cash, you must open an account and have adequate funds deposited prior to play. Only stakes placed from Your Account set up through this Site will be accepted for the Games and any winnings you make will be credited to Your Account. You may facilitate all deposits and withdrawals by accessing Your Account through the Site. Minimum and maximum limits on the amounts that you can withdraw from Your Account may apply. For your own security we reserve the right to request further identifying information prior to any withdrawals.
You may deposit funds in Your Account by using an approved credit or debit card, or other means of payment that we approve from time to time. All payments into Your Account must be from a payment source on which you are the named account holder.
We reserve the right to refuse or limit any stake at our sole discretion for any reason whatsoever. In circumstances where a stake is deemed to be or is declared void by us at our discretion, any sum deducted from Your Account in respect of that stake or wager (including any commission charged by us) shall be credited to Your Account. We further reserve the right to set maximum and minimum stake amounts which will be indicated in the game rules.
We operate the Site so as to provide a platform for users to play games with each other using the Software. In consideration of the provision by us of the facility for you to bet with other users, we charge a commission (known as rake) which is calculated in accordance with the our rake policy and as described in the FAQs section of the Site. Please refer to Help - FAQ in the main menu.
In the case of suspected or fraudulent payment, including use of stolen credit cards, by any user, or any other fraudulent activity, we reserve the right to block a user's account. We shall be entitled to inform any relevant authorities or entities (including credit reference agencies) of any payment fraud or other unlawful activity, and may employ collection services to recover payments. We reserve the right to run credit checks on a user on the basis of the information provided to us on registration.
It is your sole responsibility to inform us of any changes to your personal details, including your address, your debit or credit card number and expiry date or issue number of any card, and any other information which may impact upon the use of Your Account. Failure to inform us of such changes may result in transactions being declined by your bank or credit card company. We do not accept any liability or responsibility for transactions that are declined as a result of your failure to provide us with correct details. It is your responsibility to protect your debit and/or credit cards from loss or theft.

7. Payment Disputes
Each user is fully responsible for paying any and all monies owed by it to other users and/or to the Company. Any claim which a user may have for payment of winnings to it in respect of losing wagers by another user are against that other user, not the Company. The Company is in no way responsible to pay you if any user fails to pay for whatever reason, or for taking any action whatsoever against such users. Each user is fully responsible for paying all monies owed to any other user using the Service and assumes all risks of receiving payment from other users. All disputes that arise between users, including those related to payment fraud, are not the responsibility of the Company.

8. The Games
You should ensure that you have read and understand the rules of the games available through the Service (the "Games"). You agree to abide by the rules of each of the Games as published and periodically changed on the Site. These game rules form part of the Agreement and can be found on the Games page of the Site. Please read them before using the Service and Site.
We may, from time to time, make additional Games available through the Service. This Agreement will apply to any game rules relating to such Games. We will let you know about, and give you the opportunity to read such game rules at the time additional Games are introduced to the Site.
We reserve the right to determine the results and winners of each of the Games. By registering and/or participating in any Game or tournament you agree to be bound by these determinations. We will post lists of winners on the Site following each Game and/or tournament. We reserve the right to repeat / show a winning game, played by an End User, on the Site to other End Users.

9. Earnings
Your earnings are kept confidential. It is your responsibility to report any winnings to the appropriate taxation authorities with regard to your location.

10. Prohibited Uses of the Site and Service
10.1 Illegal Funds: You declare that the source of funds used by you on the Site is not illegal and that you will not use the Service in any way as a money transfer system. You will not use the Service for any unlawful activity or prohibited transaction under the laws of any jurisdiction that applies to you. If the Company has suspicion that you may be engaging in or have engaged in fraudulent, unlawful or improper activity, including without limitation, money laundering activities, your access to the Service may be suspended or terminated immediately and/or Your Account blocked, and the Company shall be entitled to inform relevant authorities.
10.2 Collusion: Collusion occurs when two or more users attempt to gain an unfair advantage by sharing knowledge of the Games or other information to other users' disadvantage. Any user who attempts to or colludes with any other user while using the Service may be permanently banned from using the Service or Software and their account may be terminated immediately (regardless of the provider of the Service). The Company will do its best to investigate complaints registered against users suspected of collusion. If the Company is informed during play about suspected collusive behavior, it may, in its sole discretion, terminate suspected users' access to the Service and/or block their accounts. However, under no circumstances shall the Company be liable for any loss, whatsoever, sustained by you as a result of the collusive, or otherwise unlawful activity of any person using the Service or the Software and no user shall have the right to require the Company to take any other steps against users suspected of collusion, cheating or any other form of fraud.
10.3 Artificial Intelligence: You are not allowed to use any software program endowed with artificial intelligence, including without limitation a robot, in order to assist you in your use of the Service. In the event that we deem it has been used we reserve the right to take any action we see fit, including immediately blocking access to the Service to the offending User, terminating such User's account and seizing all monies held in such account.
10.4 Manipulation of game results: As an End User, you are not allowed to affect the outcome of any game and manipulate the game result by any other means than those provided within the game. Neither is it allowed to intentionally lose games to a known or unknown opponent. In the event that the Network Operator deems you to have tried to manipulate the game result, it will take any rectifying action it sees fit including immediately blocking access to the Service by the offending End User, terminating such User's account and / or seizing all funds held in the relevant User account.
10.5 Abusive, foul or offensive language: Abusive, foul or offensive language will not be tolerated when using the Service, or otherwise by you on the Site or with Customer Service. You may also not abuse or harass any other user of the Service. Furthermore you are not allowed to communicate with other users of the Service with the intention of gaining an advantage in the games. Any violation of this policy will result in a suspension of your use of the Service or such other action as may be reasonably required by the Company to ensure compliance. In addition, you are not entitled to make untrue and/or malicious and/or damaging comments with regard to the Company's operation in any media or forum.

12. Intellectual Property
You acknowledge and agree that the information found on this Site and the technology driving the Site is either ours or a third party's trademark, service mark, copyright, trade secret, patent or proprietary rights (collectively "Intellectual Property"). You agree not to rent, lease, loan, distribute, create derivative works, copy, re-use, modify, adapt, attempt to decompile, decipher, disassemble, reverse engineer, decrypt or discover the source code of all or any portion of this Site, deploy any type of query program on the Site, create improvements, or seek to obtain intellectual property protection on the content found on this Site. The Service is made available for your personal use only.

13. Obligations of the Company
The Company has no obligation to check whether users are using the Service in accordance with this Agreement or the game rules.
Under no circumstances shall the Company be obligated to investigate or pursue any complaints made by a user against any other user using the Service or to take any other action in connection therein, or take any action against a user for any reason, including without limitation for violating the terms of this Agreement. The Company may, in its sole discretion, decide to take appropriate action against any person it suspects to be engaging in any unlawful behavior or otherwise violating the terms of this Agreement, but is under no obligation to do so.
You will not be entitled to a refund from the Company for any monies owed to you as a result of any other user's misconduct, unlawful behavior or otherwise whether or not the Company pursues any action against such user.

14. Warranty
Your use of the Site is at your sole risk. In providing the Site and Service we agree to exercise reasonable skill and care. Apart from this, any other express or implied service guarantees, assurances, warranties, conditions, terms and the like shall not apply. You acknowledge that:
(a) As with any other web pages and services provided over the internet and with the use of software and hardware generally, there may be times when the Service is interrupted, unavailable and/or contains errors, and that such situations are beyond our reasonable control;
(b) We are not responsible if the computer and software you use to access the Service crashes or experiences problems (including during the playing of games);
while we will use reasonable endeavors to try to keep the Service running at all times, we do not guarantee 24 by 7 operation 365 days a year, and
We are not liable for any resulting losses, damages or other problems suffered by you, including losing the Service during a Game.

15. Limitation of Liability
Except in the situation of death or personal injury caused by our negligence, or in respect of fraudulent misrepresentation, we will not be responsible or liable to you for any other loss or damage that you or any third party may suffer as a result of using (or in connection with your use of) the Site which is not caused by our breach of this Agreement or negligence.
Where we are in breach of this Agreement or are negligent:
(a) For claims related to a Game or Games, our liability to you for losses you have suffered as a result of that breach of Agreement or negligence shall not exceed the amount of commission paid to us by you in respect of the game in question.
(b) For any other claims for breach of this Agreement by us or in respect of our negligence, our liability shall be limited to the commission received by us from you for the 12 month period up to the point the claim was made.
In the event that you have any right, claim or action against any other user arising from the user's use of the Site, you agree to pursue such right, claim or action independently of and without recourse to us, and you release the Company (and our parent, subsidiaries, affiliates, officers, directors, agents and employees) from all claims, liability, damages, losses, costs and expenses including legal fees known and unknown, arising from or in any way connected with such right, claim or action.

16. Termination
We may terminate Your Account (including your user name and password) if (1) for any reason we decide to discontinue to provide the Service, (2) you have breached any of the terms of this Agreement, (3) your use of the Service has been in any way improper or breaches the spirit of this Agreement, or (4) for any other reason we see fit.
You may terminate Your Account at any time by giving us notice.
Subject to our forfeiture rights in Section 5 above, if Your Account is terminated by either you or us, we will pay to you any monies remaining in Your Account, subject to the charge of an administrative fee. The fee may vary depending on the circumstances of termination.

17. General
We reserve the right to modify or terminate the Service or elements of the Service at any time. We reserve the right to modify or withdraw any promotions, bonuses or special offers on the Site, subject to promotion-specific terms and conditions.
If any part of this Agreement shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the rest of this Agreement and shall not affect the validity and enforceability of any of the remaining provisions of this Agreement.
No waiver by us of any terms of this Agreement shall be construed as a waiver of any preceding or succeeding breach of any terms of this Agreement.
Unless otherwise expressly stated, nothing in this Agreement shall create or confer any rights or any other benefits to third parties. A person who is not a party to this Agreement has no right to enforce any term of this Agreement.
This Agreement shall, with the Privacy Policy and game rules and our applicable charges, rake and commissions from time to time in effect, contain the entire agreement between you and us relating to the Service. You confirm that, in agreeing to accept this Agreement, you have not relied on any representation save insofar as the same has expressly been made a representation in this Agreement.
We reserve the right to transfer, assign, sub-license or pledge this Agreement, in whole or in part, to any person without notice and you will be deemed to consent to such assignment.

18. Governing Law
This Agreement shall be governed by and construed in accordance with Finnish law and subject to the non-exclusive jurisdiction of the Finnish courts.

19. Dispute Resolution and Customer Service
Disputes between you and the Company regarding the Service may be reported to Customer Services. We encourage you to report all disputes between users to your local law enforcement body.

21. Your Representations
By accepting these terms and conditions you confirm and agree that:
(1) You are at least 18 years old, or the age of legal consent for engaging in the activities provided by the Service under the laws of any jurisdiction that applies to you, whichever is greater. We reserve the right to request additional information to validate your age.
(2) All the details contained in your registration form as submitted to us are true and correct. You will promptly notify us of any changes to those details.
(3) Your Account is for your sole, personal use only and it is not be used by you or any third party for the purpose of or in the course of any trade or business.
(4) You shall not allow any third party to use Your Account, password or user name to access or use the Service or the Software, nor shall you reveal your means of payment to access or use the Service or Software to any person. You shall not allow any person under 18 any form of access to the Service or Software. We take no responsibility for any third party access to Your Account.
(5) You have verified and determined that your use of the Service does not violate any laws or regulations of any jurisdiction that applies to you. It is your responsibility to ensure that this is the case.
(6) You fully understand the methods, rules and procedures of the Service and your use of the Service and Software will be made exclusively in accordance with this Agreement, Privacy Policy and game rules. You will not commit any acts or display any conduct that damages the reputation of the Company.
(7) You are fully aware that there is a risk of losing money by using the Service and that you are fully responsible for any such loss. You agree that your use of the Service is at your sole risk.
(8) You acknowledge that in registering and using the Service you have to provide us with certain personal details about yourself (including details regarding your methods of payment).

22. Bonus Money
The bonus money can not be withdrawn until it is cleared.
The bonus money is only valid for a certain period of time.

23. Currency
(1) The core currency utilized within the network is the Euro (€). This is the currency used for all player deposits and for all direct transactions in the network. Accordingly, the entry fees and the prizes for all tournaments in the network are calculated in Euro (€). As an end user, however, you have the opportunity to see these entry fees and prizes displayed in another currency such as, for example, Great British Pounds (£). Such a local currency display is purely indicative and the underlying transaction remains in Euro (€).
(2) The amount deposited by an end user of the games and that user’s account balance is always calculated and retained in Euro (€). Where an end user chooses to display such amounts in a non-Euro currency all such amounts are subject to variation depending on exchange rates. However, the base Euro (€) amount does not change.

24. License
The Games are licensed and regulated by the Provincial Government on Åland. The license number is K 14/05/5/129 and the license was granted to GamArena Ab and Ålands Penningautomatförening on 19 January 2006. The Games on this site are executed by GamArena Ab.
